This privacy policy explains how and when I collect, use and share any personal information when you use this website and also when you use my services through Etsy.com, Not On The High Street and in person at markets / events.

I’m committed to maintaining your trust and confidence. I would never sell or trade email lists / your information with other companies for marketing purposes.. Any data I do collect, I will endeavour to keep safe. Please read on for details of when I collect your personal information, how I use it, and how I keep it safe.

I’ve also listed my privacy policy details for Etsy, NOTHS and craft fairs / markets – although not related to any activity on this website, I’ve listed them for reasons of transparency in case you are using any of my other services. Where possible, I’ve listed in sections for ease of finding relevant information.

This site uses a third party service, Google Analytics, to collect details of visitor behaviour patterns. This helps me work out which parts of the site are most popular, and what products you like seeing the best! The information is processed in a way which does not allow me to identify anyone. Newsletter / Mailing list

As part of the registration process for the Ladykerry newsletter, I collect your email address and, in some cases, your name (providing name is optional). There are sign up options available on this website, and at markets / events.

I use your email address to let you know all kind of fun stuff – upcoming events, offers, behind the scenes sneak peeks and new products. Of course, there are lots of puns too! I send the newsletter out roughly every fortnight but will also occasionally send out flash newsletters with important news. I will never pass on / trade your details with other organisations / businesses.

You may easily unsubscribe from the Ladykerry newsletter by clicking the unsubscribe link at the bottom of the newsletter email. Alternatively, you may contact me directly at Kerry@kerrysdesign.com

I use a third party provider (Mailchimp) to create and send the Ladykerry newsletter. This service also helps me gather statistics around click open rates, and the most popular newsletter reading times.

Competitions

From time to time, I run competitions via Ladykerry social media and / or the Ladykerry newsletter. I may need to obtain personal information from the prize winner in order to deliver the prize (such as name and address details). Once delivery has been completed, I will delete this information. I may also publicise the name of the winner (first name only) – but I will always make this clear in the competition terms and conditions, and will obtain additional consent. No further details that will make the winner identifiable will be released.

Purchasing on Etsy and Not on The High Street

Information I collect on Etsy and Not On The High Street (NOTHS)
When purchasing items from Ladykerry at www.ladykerrydesign.com and www.notonthehighstreet.com/ladykerryillustratedgifts I need to collect certain information to fulfil your order. You must give Etsy / NOTHS authorisation to provide this.

The information required to process orders is your name, email address, postal address, payment information and the details of the product you’re ordering. In some cases I may need to collect additional personal information, for example if you contact me directly for a custom order or require a gift message added. 

Why I Need Your Information and How I Use It
This information is collected from you so that I can:

  • Process orders / payments submitted by you
  • Communicate with you regarding your order / provide customer support
  • Verify your identity where necessary
  • Fulfil your order
  • Comply with my obligations under the Etsy Seller Policy and Terms of Use / NOTHS Terms of Use
  • Provide evidence of transactions to HMRC Tax Office, and complete my tax records

Information Sharing and Disclosure
Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

  • I share information as necessary with Etsy / NOTHS in order to provide my services to you and ensure I comply with their Terms of Use.
  • I share limited information with service providers, such as delivery companies, in order to fulfil your order. I will only ever share the information that is required to perform these services.
  • If I sell or merge my business, I may disclose limited information as part of that transaction – only to the extent required by law. (Don’t worry, I have no plans of selling – this is just to ensure you are fully informed of a possible scenario).
  • Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Google analytics – Etsy
I use Google Analytics (Etsy only) to monitor things such as – times of popularity on my Etsy page, and which products are viewed the most. All information is gathered anonymously and the information gained helps me improve the Etsy experience for you – for example, by learning which products are the most popular.

Craft fairs / markets

Craft fairs – iZettle
As well as cash payments, I also accept card payments at craft fairs / markets. I use a third party service, iZettle, to fulfil these card transactions. iZettle processes your card information – I have no access to your personal information, unless you request a receipt which is then issued via obtaining your email address or phone number. Craft fairs – newsletter
You may also sign up to the Ladykerry newsletter at craft fairs / markets. A copy of the Ladykerry privacy policy will be made visible at point of sign up and you may easily unsubscribe from the Ladykerry newsletter by clicking the unsubscribe link at the bottom of the newsletter email. Data Retention

I retain your personal information for as long as necessary to provide you with my services. However, I am also required to keep some information for tax purposes – I must keep evidence of transactions / invoices for 7 years for HMRC. In some cases I may also keep limited information for a longer time period in order to fulfil future services – for example, if you have commissioned a piece by me and would like to make updates and reorder the commission at a later date.

Keeping your data safe

For the purposes of fulfilling your order in Etsy / NOTHS I need to download name and address details for delivery. I have a process of regularly deleting these downloaded files off my computer. In addition, files are encrypted and my computer is password protected.

I additionally need to keep limited information about sales for tax purposes / HMRC requirements. This information is kept securely stored. Any printed documents (for example; receipts) are held in a locked facility and will only be used as stated above. I ensure all security is the best it can be in order to mitigate any potential risks and safeguard your privacy from unauthorised access / improper use.

Third Parties

In addition to the third parties listed above, there may be times when I need to work with additional third parties to process orders or for tax purposes. I will ensure that these third parties are GDPR compliant, and will update my own Privacy Policy as and when required.

Currently I work with an accountant for tax purposes. This accountant sees limited / restricted information on invoices etc.

Access to your personal information

You are entitled to view, amend, or delete the personal information that I hold. Email your request to Kerry Stewart (Data Protection Officer) at @kerrysdesign.com.

If you reside in the EU and wish to raise a concern / complaint about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

Changes to this Privacy Notice

This privacy notice will be reviewed regularly and changes made as and when regularly. The last date of update was 9th May 2018.
